This Privacy Policy sets out how Tradelander 5cc (“Tradelander”, “we”, “us”, or “our”) collects, processes, stores, and protects personal information collected via our website (tradelander.co.za), telephonic communications, WhatsApp dispatch channels, and electronic correspondence.

Tradelander 5cc operates as a Responsible Party as defined in Section 1 of the Protection of Personal Information Act, No. 4 of 2013 (“POPIA”). We determine the purpose of and means for processing personal information in connection with commercial heavy freight transport, logistics management, telematics coordination, and warehousing operations throughout Southern Africa.

• “Personal Information” means information relating to an identifiable, living, natural person, and where applicable, an identifiable, existing juristic person (including companies and partnerships), as stipulated in Section 1 of POPIA.
• “Data Subject” refers to you — our prospective or active client, supplier, partner, driver, or visitor to our website whose personal data is processed.
• “Processing” means any operation or activity, whether automated or not, concerning personal information, including collection, receipt, recording, organization, storage, updating, retrieval, consultation, dissemination, erasure, or destruction.
• “Operator” means a person or entity that processes personal information for a responsible party in terms of a contract or mandate, without coming under the direct authority of that party.

Under Section 11 of POPIA, Tradelander 5cc processes personal information strictly for legitimate commercial, contractual, and statutory purposes:

• Contractual Performance: Processing freight rate quotes, assessing vehicle capacity (Superlinks, Tri-axles, Tippers, Light Fleet), scheduling cargo dispatches, coordinating driver routes, issuing manifests, and managing accounting.
• Legitimate Interests: Operating 24/7 satellite telematics, GPS vehicle monitoring, cargo tracking, and incident management to protect client commodities and ensure road safety.
• Statutory Compliance: Maintaining commercial records in accordance with the South African Revenue Service (SARS), the National Road Traffic Act, the Companies Act 71 of 2008, and cross-border customs regulations.
• Customer Service: Providing prompt responses to inquiries received via our Direct Contact Drawer, email desk (ops@tradelander.co.za), and phone lines.

We collect personal information directly from you when you:

Tradelander 5cc does not sell, rent, or trade your personal information to third parties for marketing purposes. We only share information with authorized operators who are contractually bound to comply with POPIA confidentiality and security standards:

• Telematics & Fleet Security Providers: Certified satellite tracking and surveillance platforms facilitating real-time cargo monitoring and control-tower oversight.
• Insurance Underwriters: Verifying load specifications for Goods in Transit (GIT) policy compliance and claim administration.
• Digital Infrastructure & Cloud Hosts: Certified hosting providers (Netlify, Google Workspace / SMTP) that encrypt and deliver web form communications to our dispatch desk.
• Regulatory Authorities: Law enforcement, SARS, or statutory bodies when required by South African law or valid judicial order.

In facilitating regional logistics across Southern Africa (including cross-border SADC corridors), personal and cargo information may occasionally be transferred across national borders for customs clearance, border post documentation, and local dispatch management.

Such transfers are conducted in strict accordance with Section 72 of POPIA, ensuring that the recipient is subject to a law, binding corporate rules, or an agreement that provides an adequate level of data protection comparable to South Africa’s POPIA standards.

Tradelander 5cc implements appropriate, reasonable technical and organizational measures to prevent the loss of, damage to, or unauthorized destruction of personal information, and unlawful access to or processing of personal information, as required by Section 19 of POPIA:

• End-to-End Encryption: 256-bit TLS/SSL encryption for all data in transit across our website and automated SMTP gateway.
• Access Controls: Role-based access restrictions ensuring only authorized operations and dispatch personnel have access to commercial inquiries.
• Anti-Spam & Threat Mitigation: Serverless sandboxing, silent honeypot filtering, and secure email authentication (SPF, DKIM, DMARC).
• Incident Response: Procedures in place to identify, investigate, and notify affected data subjects and the Information Regulator in the unlikely event of a verified data compromise.

We retain personal information only for as long as necessary to achieve the purpose for which it was collected, or as required by applicable South African statutes:

• Commercial transaction records, delivery notes, and tax invoices are retained for a minimum of five (5) years as required by the Tax Administration Act and the Companies Act.
• General web inquiries that do not result in a commercial service agreement are archived or permanently destroyed after the resolution of the customer inquiry.

Upon expiry of the statutory retention period, personal information is permanently destroyed, de-identified, or deleted in a manner that prevents its reconstruction.
